Translation of Ecuadoran Government Declaration Dissolving Fundacion Pachamama

When the Ecuadoran government raided the Quito offices of the Fundacion Pachamama on December 4, they handed over this declaration dissolving the organization, which has spent 16 years working for indigenous human rights and the rights of nature. The government took this action in retaliation for Pachamama’s opposition to expansion of oil drilling in the Amazon rainforest.

Accord No. 125

The Ministry of Environment

Considering

That the Constitution of the Republic of Ecuador, in Article 66, Section 13, recognizes and guarantees the people: “The right to associate, assemble and demonstrate freely and voluntarily”;

That the Codification of the Civil Code, published in the Supplement to the Official Register No. 46 of June 24, 2005 in Article 577 first paragraph provides that corporations can not be dissolved by themselves, without the approval of the authority that legitimized its establishment;

That, by Executive Order No. 16, published in Official Register Supplement No. 19 of June 20, 2013, the Regulations for the Operation of the Unified Information System of Social and Citizen Organizations, whose Article 26 states as grounds for dissolution in paragraph 2: “Deviating from the aims and objectives for which it was created” and in paragraph 7: “Engaging in partisan political activities, reserved for political parties and movements registered with the National Electoral Council, of interference in public policy that threatens the internal or external security of the state, affecting public peace.”

That on the said Regulation for the Operation ofUnified Information System of Social and Citizen Organizations, in its Article 28 states: “The civil society orgnizations will be dissolved and liquidated by their own initiative or upon complaint, which the diversion of its purposes is evidenced or have committed any of the grounds for dissolution…”

That by Ministerial Decision No. 250 dated December 30, 2010 , the Environment Minister, authorized the Coordinator General ‘s Legal various functions , among which is contained in Article 1, subparagraph d ) ” Approving Statutes corporations , foundations and associations linked to the areas of competence of this Ministry and their reforms, as well as dissolve , giving reasons , corporations , foundations and associations under the grounds provided for in the bylaws of each organization ” ;

That, in letter No. MDI-VSI-2013-00030 of December 4, 2013 the Deputy Minister of Internal Security, Ministry of Interior, Mr. Javier Felipe Córdova Unda requests that the Ministry of Environment execute the immediate dissolution of the Pachamama Foundation in compliance with the second and seventh paragraphs of Article 26 of the Regulations for the Operation of the Unified Information System of Social and Citizen Organizations.

That, the letter No. MDI-VSI-2013-00030 of December 4, 2013 and the documents attached thereto, it is clear that “On November 28, 2013, bidding proceeded for thirteen hydrocarbon blocks, an event which was attended by government officials, leaders of local indigenous nationalities as well as several international and national authorities, among them the Ambassador of the Republic of Chile, Juan Pablo Lira and the Director of the company Belorusneft of the Republic of Belarus, Andrey Nikonov. Despite the normal development of the event, upon the time of completion, a group of pseudo activists representing the organizations “Pachamama” and “The Ant” began a violent protest, undermining public order and the physical integrity of the attendees, especially the aforementioned officials, who members of the National Police proceeded to protect and enable their departure, but not before also being assaulted physically and verbally (…) for these reasons and on the basis of the provisions of the eighth paragraph of Article 3 of the Constitution of the Republic of Ecuador, which makes it a prime duty of the State to guarantee its citizens the right to a culture of peace, integral security and to live in a democratic society, that Ministry in its capacity as lead agency for domestic protection, maintenance and control of public order in accordance with the provisions of the letter b) of Article 11 of the Law on public Security and the State requested that the Ministry of Environment execute the immediate dissolution of the “Pachamama” Foundation, in compliance with the second and seventh paragraphs of Article 26 of the Regulations for the Operation of the Unified Information System of Social and Citizen Organizations, to be evidenced by their violent acts, the deviation from the aims and objectives for which it was created, and for intervention in public policy attacking the internal security of the State and affecting the public peace.”

That upon analysis of the police reports and magnetic records attached to letter No. MDI-VSI-2013-00030 of December 4, 2013 facts are evidenced in a report which the configuration of the grounds for dissolution under Article 26 of the Regulations for the Operation of the Unified Information System of Social and Citizen Organizations in section 2, as follows: “To deviate from the aims and objectives for which it was created” and in paragraph 7: “To engage in partisan political activities reserved for political parties and movements registered with the National Electoral Council, interference in public policy that undermines the internal or external security of the State, affecting public peace.”

That, in exercise of the powers set out in Article 154 paragraph 1 of the Constitution of the Republic of Ecuador, the Executive Decree No. 16. published in the Supplement to Official Register No. 19 of 20 June 2013.

 

AGREES

Article 1.- To dissolve the Pachamama Foundation, located in the city of Quito, Pichincha Province, approved pursuant to Ministerial Decree No. 52 of 6 November 1997, the same that is void under this Agreement, for being guilty of the second and seventh grounds for dissolution under Article 26 of the Regulations for the Operation of the Unified Information System of Social and Citizen Organizations.

Article 2.- To serve a copy of this Agreement to the “Pachamama” Foundation, in accordance with the provisions of Sections 126 and 127 paragraph 1 of the Statute of the Administrative Legal System of the Executive Branch.

Article 3.- To solicit and direct the General Administration of Police of Pichincha, in order to verify and execute the provisions in this Agreement.

Article 4.- To bring this resolution to the attention of the lnternal Revenue Service, the Superintendency of Banking and Insurance, the National Secretariat of Policy Management and Superintendency of Popular Economy and Solidarity.

Article 5.- This Agreement becomes effective upon signature without prejudice to its publication in the Official Register.

ACUERDO No. 125

El Ministerio del Ambiente

Considerando

Que, la Constitución de la República del Ecuador, en el Articulo 66, numeral 13, reconoce y garantiza a las personas: “El derecho a asociarse, reunirse y manifestarse de forma libre y voluntaria”;

Que, la Codificación del Código Civil, publicada en el Suplemento del Registro Oficial N° 46 de 24 de junio de 2005 en su Artículo 577 primer inciso establece que las corporaciones no pueden disolverse por si mismas, sin la aprobación de la autoridad que legitimó su establecimiento;

Que, mediante Decreto Ejecutivo N° 16, publicado en Suplemento del Registro Oficial N° 19 de 20 de junio de 2013, se expidió el Reglamento para el Funcionamiento del Sistema Unificado de información de las Organizaciones Sociales y Ciudadanas, cuyo Artículo 26 manifiesta como causales de disolución en el numeral 2: “Desviarse de los fines y objetivos para los cuales fue constituida” y en el numeral 7: “Dedicarse a actividades de política partidista, reservadas a los partidos y movimientos políticos inscritos en el Consejo Nacional Electoral, de injerencia en políticas públicas que atente contra la seguridad interna o externa del Estado, que afecten la paz pública”.

Que, en el mencionado Reglamento para el Funcionamiento del Sistema Unificado de información de las Organizaciones Sociales y Ciudadanas, en su Articulo 28 establece que: “Las organizaciones de la sociedad civil, podrán ser disueltas y liquidadas de oficio o por denuncia, de la que se evidencie el desvío de sus fines o haber incurrido en cualquiera de las causales de disolución…”

Que, mediante Acuerdo Ministerial N° 250 de fecha 30 de diciembre del 2010, la Ministra del Ambiente, facultó al Coordinador General de Asesoría Jurídica varias de sus funciones, entre las que consta en el Artículo 1, literal d) “Aprobar los Estatutos de corporaciones, fundaciones y asociaciones vinculadas a los ámbitos de competencia de este Ministerio y sus respectivas reformas; al igual que disolver, de forma motivada, las corporaciones, fundaciones y asociaciones conforme a las causales previstas en el Estatuto Social de cada organización”;

Que, mediante oficio No. MDl-VSl-2013-00030 del 4 de Diciembre del 2013 el Señor Viceministro de Seguridad Interna del Ministerio del Interior, Sr. Javier Felipe Córdova Unda, solicita que el Ministerio del Ambiente proceda a la disolución inmediata de la Fundación PACHAMAMA en apego a los numerales segundo y séptimo del artículo 26 del Reglamento para el Funcionamiento del Sistema Unificado de información de las Organizaciones Sociales y Ciudadanas.

Que, del oficio No. MDI-VSI-2013-00030 del 4 de Diciembre del 2013 y de la documentación anexa al mismo, se desprende que “El dia 28 de noviembre de 2013, se procedió a la apertura de ofertas para trece bloques hidrocarburíferos, evento en el cual participaron funcionarios públicos, dirigentes de las nacionalidades indígenas locales, así como varias autoridades internacionales y nacionales, entre estos el Embajador de la República de Chile, Juan Pablo Lira y el Director de la empresa Belorusneft de la República de Belarus, Andrey Nikonov. No obstante el normal desenvolvimiento del evento, al momento de su finalización. un grupo de seudo activistas representantes de las organizaciones “Pachamama” y “La Hormiga” iniciaron una violenta protesta, atentando contra el orden público y la integridad física de los asistentes, especialmente sobre los antes referidos funcionarios; ante lo cual los miembros de la Policía Nacional presentes, procedieron a resguardar y permitir su salida, no sin antes ser también agredidos física y verbalmente (…) Por lo expuesto y sobre la base de lo dispuesto en el numeral octavo del artículo 3 de la Constitución de la República del Ecuador, que establece que es un deber primordial del Estado garantizar a sus habitantes el derecho a una cultura de paz, a la seguridad integral y a vivir en una sociedad democrática, esta Cartera de Estado en su calidad de entidad rectora de la protección interna, y mantenimiento y control del orden público de acuerdo a lo dispuesto por la letra b) del artículo 11 de la Ley de Seguridad Pública y del Estado, solicita que el Ministerio del Ambiente, proceda a la disolución inmediata de la Fundación “Pachamama”, en apego a los numerales segundo y séptimo del artículo 26 del Reglamento para el Funcionamiento del Sistema Unificado de información de las Organizaciones Sociales y Ciudadanas; al evidenciarse con sus violentos actos, la desviación de los fines y objetivos para los cuales fue constituida; y, por injerencia en políticas públicas atentando contra la seguridad interna del Estado y afectando a la paz pública”.

Que, del análisis de los Partes Policiales y registros magnéticos anexos al oficio No. MDl-VSI-2013-00030 del 4 de Diciembre del 2013. se evidencian hechos constitutivos en una denuncia de la cual se desprende la configuración de las causales de disolución del Artículo 26 del Reglamento para el Funcionamiento del Sistema Unificado de información de las Organizaciones Sociales y Ciudadanas en el numeral 2: “Desviarse de los fines y objetivos para los cuales fue constituida” y en el numeral 7: “Dedicarse a actividades de política partidista. reservadas a los partidos y movimientos políticos inscritos en el Consejo Nacional Electoral, de injerencia en políticas públicas que atente contra la seguridad interna o externa del Estado, que afecten la paz pública”.

Que, en uso de las atribuciones establecidas en el Artículo 154 numeral 1 de la Constitución de la República del Ecuador; del Decreto Ejecutivo No. 16. publicado en el Suplemento del Registro Oficial No. 19 del 20 de Junio de 2013.

ACUERDA

Art. 1.- Disolver de oficio a la Fundación Pachamama, con domicilio en la ciudad de Quito, Provincia de Pichincha. aprobada mediante Acuerdo Ministerial No. 52 del 6 de Noviembre de 1997, el mismo que queda sin efecto en virtud del presente Acuerdo, por haber incurrido en las causales de disolución segunda y séptima del Artículo 26 del Reglamento para el Funcionamiento del Sistema Unificado de Información de las Organizaciones Sociales y Ciudadanas.

Art. 2.- Notifíquese con una copia del presente Acuerdo a la Fundación “Pachamama”, de acuerdo a lo dispuesto en los Artículos 126 numeral 1 y 127 del Estatuto de Régimen Jurídico Administrativo de la Función Ejecutiva.

Art. 3.- Solicitar y Oficiar a la Intendencia General de Policía de Pichincha, a fin de que verifique y proceda a ejecutar la disposición constante en el presente Acuerdo.

Art. 4.- Póngase en conocimiento la presente resolución al Servicio de Rentas lnternas, a la Superintendencia de Bancos y Seguros, a la Secretaría Nacional de Gestión de la Política y Superintendencia de Economía Popular y Solidaria.

Art. 5.- El presente Acuerdo tendrá vigencia a partir de su suscripción sin perjuicio de su publicación en el Registro Oficial.
